SIZE DIVERSE PILATES – TEACHER TRAINING PROGRAM AGREEMENT

 

Welcome to Teacher Training Program (the “Program”) with Size Diverse Pilates, LLC (“Size Diverse Pilates”). We are looking forward to working together throughout the duration of the Program. 

 

Below are the terms of this “Agreement” to set forth the details of working with Size Diverse Pilates in the Program. We encourage you to read this information carefully and fully to create clarity of our respective roles and expectations while working together, and to set You, the undersigned, up for a positive, productive, and results-driven enrollment. 

 

By signing below, we both legally agree to the following: 

 

1 - PROGRAM DESCRIPTION

The Size Diverse Pilates Teacher Training Programs are for anyone looking for a positive learning environment to expand their knowledge of the Pilates method, and possibly teach one day. The Mentorship is designed to use positive language around the human body to create movement possibilities for any body type. Trainees will build their knowledge, teaching skills, and personalized teaching styles while becoming more confident in their own movement abilities. At the end of the Program, each participant will be equipped with a library of movement ideas to continue their exploration.

 

All Size Diverse Pilates Mentorships & Training Programs are designed to provide guidance in a supportive and inclusive way. The Size Diverse Pilates environment encourages critical thinking for the teachers in training, so they may provide clients with the best possible movement experiences during each session. We believe that the body changes and feels different each time we practice, and we encourage exploration based on these changes and feelings. We also believe that everyone should have the opportunity to practice and learn in a safe environment.

 

Note: The training manuals were created specifically to include positive movement ideals and body, race, and gender neutral language. We will continue learning and updating the manual to continue creating an inclusive environment each time we train.

 

We built the program on three (3) foundational principles:

1. A place for anyone to feel like they belong and help them learn to teach others.

2. Accommodating different learning styles and helping trainees learn different ways to teach to best help their students.

3. Practice a Move + Learn + Teach cycle

 

PROGRAM CURRICULUM: 

The Program is self-guided and self-paced, and spans approximately a 1 - 2 years pending the program, however your access to the Workshops can be up to 3 years for You to complete all hours. 

 

The Program includes: 

• Live, in-person and virtual “Workshops”

• Hard-copy manual,

• Educational videos accessed on the Platform and other third-party platforms,

• PDF printables,

• Access to a Google Drive and Google Calendar with shared information and documents related to the Program,

• Written tests, 

• Performance tests, 

• Teaching tests, 

• Practice clients required, 

• Self-practice hours. 

The hours required to complete each specific program (Mat, Reformer, Mat + Reformer, Comprehensive) are further described in Exhibit A, attached hereto.

 

Note that any expense incurred related to your self-practice (booking your own classes), observation, and practice teaching are NOT included in the cost of the Program and solely your responsibility. 

 

2 – PREREQUISITES AND ENROLLMENT

 

PROGRAM PREREQUISITES: In addition to the following technical qualifications as a prerequisite for enrollment in the Program, Size Diverse Pilates also requires You to abide by the philosophies described above in the “Program Description” and the “Code of Conduct” outlined below. 

 

For the Mat Training Program: there are no prerequisites to enrollment. 

 

For the Reformer Training Program: previous Mat Pilates training and/or previous Reformer training. 

 

For the Mat + Reformer Training Program: there are no prerequisites to enrollment. 

 

For the Comprehensive Training Program: there are no prerequisites to enrollment. 

 

ENROLLMENT: To enroll in the Program, You must: 

• Either remit a deposit or the investment in whole to Size Diverse Pilates,

• Agreeing to the terms of this Agreement, and

• Create a user account (“Account”) on the Program platform (“Platform”) that will allow You to access Program materials, as applicable.  

 

Upon receipt and completion of the aforementioned, You will receive confirmation that You have successfully been enrolled in the Program. 

 

3 – INVESTMENT

 

INVESTMENT: By enrolling in the Program, You agree that You are financially willing and able to invest the cost of the Program, and that by so doing, You are not incurring any economic hardship in any way. 

 

If paying in full, You may either purchase the Program online, in a one-time transaction via e-transfer check, directly to Size Diverse Pilates. By purchasing online via PayPal, You agree that the PayPal processing fee, in the amount of approximately 3% of the Program purchase price, will be added automatically at checkout. If You would like to e-transfer funds, please reach out to Size Diverse Pilates to obtain e-transfer instructions. 

 

NOTE that if this Agreement is terminated by You OR Size Diverse Pilates for conduct as described below, prior to your final payment and the culmination of the Program, You are still financially responsible for the balance owed, AND may incur additional costs and fees. See your invoice for specific details about payment totals and due dates. 

PAYMENT AUTHORIZATION: If You are paying for the Program in installments, You agree to save a valid and up-to-date credit card or debit card on file in your Account. You further agree that Size Diverse Pilates may charge, without any additional authorization required, the credit card or debit card You saved to your Account each month for the installment payment owed, throughout the duration of the Program, and agree to the terms of conditions of the Platform. Upon billing, You will receive an electronic receipt to the email on file indicating the same. 

 

MISSED PAYMENT: If payment is not received by the date due or there is a problem with the payment transaction or method (such as a declined credit card or insufficient funds), You will be promptly notified via email. Upon the payment default, You are granted a 3-day grace period to make the payment, in addition to a $50 administrative fee. If your payment has not been received following your 3-day grace period, your access and privileges associated with the Program will automatically terminate and You will no longer be granted access. 

 

ENROLLMENT CANCELLATION, REFUND POLICY: You may cancel your enrollment in the Program up to one-month prior to the commencement of the Program. In doing so, You will be assessed a cancellation fee of $500, which will be deducted in the refund of your enrollment fee.

 

It is the intention for You to be happy with your participation and results in the Program. Due to the extensive time, effort, preparation, and care that goes into creating and/ providing the Program, no refunds will be provided once the Program has begun, and the first Workshop (as defined below) has started. 

 

If You are on a payment plan: previous payments will not be refunded, and You are expected to fulfill your financial obligation for all future payments. 

 

Unless otherwise provided by law, You acknowledge that all sales are final and Size Diverse Pilates does not offer refunds for any portion of your payment for any of the Program at any time. By signing this Agreement, You agree that You will not issue a chargeback for any payment made as you are fully aware of this Refund Policy and voluntarily consenting to it. 

 

Should You attempt to issue a chargeback with your credit card company, this Agreement will automatically terminate upon such attempt, regardless of whether the attempt is successful or not, and You will lose access to all Program material. You will still remain contractually responsible for payment of the Program in full. 

4 – PROGRAM PARTICIPATION AND COMPLETION; TEACHING RIGHTS

 

You will access Program materials as follows:

• A Google Drive, with digital materials, shared with You upon enrollment

• A hard-copy manual, mailed to You, 

• The Platform, which will house additional digital materials. 

 

Size Diverse Pilates will ensure that all Program material is housed appropriately, and that You know where to locate all materials to successfully complete the hours of the Program. You are responsible for submitting your hours through the Google Drive or via email. 

 

PRACTICE TEACHING: As part of the Program, You are teaching practice clients. It is imperative that You have and utilize a Liability Waiver with these practice clients, as to avoid your own liability. By entering into this Agreement You agree, and your clients agree that Size Diverse Pilates is NOT responsible or liable in any way for any injuries or damages occurred during your practice teaching. For further language on this, see “Personal Responsibility, Disclaimer, and Release and Claims ” below. 

 

You are also responsible for finding the space and equipment for your self-practice and practice teaching. Any expense incurred related to your self-practice, observation, and practice teaching are NOT included in the cost of the Program and solely your responsibility. This includes but is not limited to: purchasing any props You wish to use during the Program and/or renting studio space. While Size Diverse Pilates does offer virtual options for observation, at least a proportion of the hour requirement shall be completed in-person for a real-life experience. 

 

OBSERVATION HOURS: As part of the Program, You are also responsible for observing live classes and private sessions. While Size Diverse Pilates offers a limited number of virtual options for observation, it is imperative that You are also observing live, in-person classes and sessions with people for a real life experience. 

 

PROGRAM COMPLETION: In order to complete the Program, You must do the following to receive a teaching certificate. 

• Satisfactorily complete both 1) written test(s), and 2) performance test(s) of the Mat and/or Reformer order,  determined by your Program enrollment, on a predetermined date, with a minimum passing score; 

• Satisfactorily complete in-person or virtual teaching assessments consisting of You teaching a both 1) private session and 2) group class for Mat and/or Reformer, determined by your Program enrollment.

  • Note that there is an additional cost associated with this portion of the teaching assessment as You will meet with a Size Diverse Pilates instructor.   

• Complete an anatomy course, recommended by/approved by Size Diverse Pilates, hosted by a third-party. (Note that this course is an additional cost to the Program). 

 

Note that as there are separate tests for the Mat program, the Mat + Reformer program, and the Comprehensive program, You may be required to take multiple tests and perform multiple assessments. 

 

Size Diverse Pilates reserves the right to respectfully reschedule any testing session in the event of an emergency to the first mutually agreeable time available. 

 

CONTINUING EDUCATION CREDITS: Upon satisfaction completion of the Program, You may be eligible for Continuing Education Credits with the National Pilates Certification Program. Please discuss this directly with Size Diverse Pilates, who will be able to provide specific requirements and paperwork, if applicable. 

 

TEACHING RIGHTS: Upon satisfactorily completing the Program You may begin teaching Pilates online under your own business name. Size Diverse Pilates will make recommendations on how to do this appropriately, as well as business coaching recommendations. 

You understand that by completing the Program you ARE ‘certified to teach Pilates,’ but are NOT a Nationally Certified Pilates Teacher. You will receive the tools needed to test for the appropriate certification. You will however receive a certificate of completion from the Program, and a reference from your mentor if You wish to teach in the future.

You may also use verbiage such as:

 

 “Certified in Mat Program with 200+ program hours including observation, practice, and teaching.”

 

“Certified in Mat and Reformer program with 500+ program hours including observation, practice, and teaching.”

 

“Certified in Comprehensive program, including Mat, Reformer, Cadillac, Chair, and Small Apparatus and Gizmos with 800+ program hours including observation, practice, and teaching”

 

CONTINUED EDUCATION: In the event You would like ongoing teacher support, training, and education, You may pay a smaller fee to come to any new workout that Size Diverse Pilates may host. You also may enroll in future mentorships, open studio, and other virtual classes, as they occur. 

 

LIABILITY CONSIDERATIONS: While not responsible or liable in any way for your future teaching endeavors, Size Diverse Pilates strongly recommends You carry/employ the following as an instructor: 1) Professional Liability Insurance, 2) Liability Waiver, and 3) CPR/AED certification.

5 - INTELLECTUAL PROPERTY RIGHTS 

Size Diverse Pilates retains all ownership and intellectual property rights to the Program content and materials provided to You through the Program, including all copyrights and any trademarks belonging to Size Diverse Pilates and related entities. The Program content and materials are being provided to You for your individual use only and with a single-user license; this means that You are NOT allowed or authorized to share, copy, sell, post, distribute, reproduce, duplicate, trade, resell, exploit, or otherwise disseminate any portion of the Program or Program materials, electronically or otherwise, for business or commercial use, or in any other way that earns You money, without my prior written permission. 

 

By signing this Agreement, You agree to the above terms, and understand that Size Diverse Pilates’ and Program’s materials are protected by the United States Intellectual Property laws, including the Copyright Act of 1976. You agree not to share, sell, adapt, edit, summarize, copyright, publish, exhibit, or distribute any digital materials, content, or videos that You have been given access to during the Program. Content includes but is not limited to the Teacher Training Manuals, other printed materials, and any videos and/or photos.

 

You further agree that any content that You submit to Size Diverse Pilates – such as video recordings of You practice teaching – may be used for future Programs and/or training without compensation, and You grant the rights over the material sent to be used to publicize diversity within the Program.

 

You understand and agree that 1) this grant of rights is made without time, place, manner, or use, and is extended to successors of Size Diverse Pilates, including, without limitation, future owners, and that 2) violating the terms of this Agreement may subject You to legal action and that Size Diverse Pilates will pursue all remedies at law against You to the fullest extent which she is entitled. 

 

6 - PERSONAL RESPONSIBILITY, DISCLAIMER & RELEASE OF CLAIMS 

NO GUARANTEE OUTCOMES: You understand that the Program outcomes can be subjective and vary greatly depending upon circumstances and individual effort invested in the Program process. Joining this Program does not guarantee that You will achieve any specific feeling or physical feat and does not offer any guarantee of success. As such, You understand that Size Diverse Pilates makes no guarantee, representation or warranty of any nature or kind that this Program will be effective or will result in any particular outcome. You agree that You will not hold the responsible, in whole or in part, for any result that You do or do not achieve.

PERSONAL RESPONSIBILITY, ASSUMPTION OF RISK, MEDICAL CLEARANCE: You acknowledge that You take full responsibility for yourself and all decisions made before, during and after your participation in the Program. You accept full responsibility for your choices, actions and results before, during and after this Program, and You knowingly assume all of the risks of the Program related to your use, misuse, or non-use of the Program or any of the Program materials. You understand and agree that you are solely responsible for your results. 

 

You agree that Size Diverse Pilates is not responsible for your physical, mental, emotional, and spiritual health, or for any other result or outcome that you may experience through this Program. Nothing related to this Program is intended to be considered medical or mental health advice in any way.

Lastly you agree that in consideration of your participation in the Program You have completed and agree to all terms in the Liability Waiver, Agreement to Participate, and Assumption of Risk provided by Size Diverse Pilates AND that if You that you received clearance from your doctor and/or physical therapist to resume physical activity, including but not limited to Pilates, strength training and stretching. 

LIMITATION OF LIABILITY, INDEMNIFICATION, AND RELEASE OF CLAIMS: You agree that Size Diverse Pilates will not be held responsible in any way for the information that You request or receive through this Program, including your services, products, and Program materials and any other information you have received from or through me related to this Program. You agree that You fully and completely, on behalf of your heirs, next of kin, family members, estate, beneficiaries, and representatives: (1) will not institute or attempt to institute any legal action, arbitration, demand, or processing; AND (2) hold harmless, indemnify, defend, and release Size Diverse Pilates, in her individual capacity and legal capacity, and each of Size Diverse Pilates’ companies’ principles, shareholders, officers, directors, employees, agents, successors, beneficiaries and assigns from any and all liability, damages, causes of action, allegations, suits, sums of money, claims, and demands whatsoever, in law or equity, that You ever had, now have or may have against Size Diverse Pilates in the future that may arise from your participation in the Program, including all services and products to the extent permitted by applicable law. 

 

6 - OTHER IMPORTANT TERMS 

 

TERMINATION: Either party may terminate this Agreement at any time, for any reason, without prior written notice; the financial obligations of this Agreement – such as the cancellation fees/refund policies – still apply regardless of which party terminates the Agreement 

CODE OF CONDUCT: You understand that the Program is a safe and inclusive space for ALL humans. 

Your enrollment will be immediately terminated, per the terms of this Agreement in the event of any of the following: You act or are involved in: 1) any occurrence which violates a widely-held principles of public  morality or decency; 2) a felony or a crime of moral turpitude; 3) any misconduct, act, situation,  or occurrence that brings You into public disrepute, scandal, ridicule, or shocks the conscience  and offends the community; 4) damaging or unfavorable public statements regarding your  relationship with Size Diverse Pilates or the teaching space you are using (such as a Pilates studio), and affiliates including but not limited to on social  media platforms; 5) remarks that speak unfavorably or Size Diverse Pilates or the Program; 6) behavior that  reflects unfavorably upon Size Diverse Pilates; 7) falsifying observation, self practice, session, or practice teaching hours; or 8) behavior towards a mentor, another trainee, any practice client, or any other human being that is degrading, competitive, non-inclusive, fat phobic, racist, and/or ableist.

 

Furthermore, it is not required, but it is suggested that the You read the Scope of Practice and the Code of Ethics outlined by the National Pilates Certification Program.

 

NOTICE: All correspondences or notices required regarding the Program shall be made to Size Diverse Pilates via email at teachertraining@sizediversepilates.org and to You at the e-mail address You provided during your enrollment in the Program. Should your email address, billing information, or contact information change at any time throughout the Program, it is your responsibility to provide your updated information to me within 3-days of any change. 

 

FORCE MAJEURE: In the event that any cause beyond my reasonable control, including, without limitations, “acts of God”/nature, war, curtailment, or interruption of transportation facilities, threats or acts of terrorism, State Department travel advisories, labor strikes or civil disturbances, unforeseen or foreseen human-initiated circumstances, health or travel restrictions, quarantines, lockdowns or precautions imposed by any government entity or agency, local, state or federal law or ordinance, or other instances, make it inadvisable, illegal, impracticable, or impossible for Size Diverse Pilates to perform my responsibilities or obligations under this Agreement, either because of unreasonable increased costs or the risk of injury, Size Diverse Pilates is not be liable for a reasonable period of delay or for the inability to indefinitely fulfill my responsibilities and obligations. 

 

ENTIRE AGREEMENT, ASSIGNMENT, SURVIVABILITY AND WAIVER: This Agreement contains our entire agreement and may be modified or amended at any time as long as the amendment is in writing and signed by both parties. You may not assign your privileges, rights or obligations under this Agreement to anyone else, and the obligations under this Agreement shall survive indefinitely unless otherwise stated in this Agreement. If Size Diverse Pilates chooses to waive or not enforce one or more terms of this Agreement, it does not in any way limit her right to later enforce every part of this Agreement. 

 

GOVERNING LAW: This Agreement shall be construed according to the laws of the County of Johnson in the State of Iowa  

 

DISPUTE RESOLUTION: Should the parties ever have any differences, it is hoped that they could work them out amiably through e-mail correspondence. However, if the parties are unable to seek resolution in 14-days, they agree now that the only method of legal dispute resolution that will be used is binding arbitration before a single arbitrator, jointly selected by both of them, unless agreed otherwise in writing. You understand and agree now that the only remedy that can be awarded to You through arbitration is the full refund of your Payment made to date. No other actions or financial awards of consequential damages, or any other type of damages, may be granted to You. The parties both agree now that the decision of the arbitrator is final and binding and may be entered as a judgment into any court having the appropriate jurisdiction. You also agree that should arbitration take place, it will be held in the County of Johnson in the State of Iowa where the principal place of business is located. 

 

MUTUAL NON-DISPARAGEMENT: Should You have any questions or concerns about the Program or Size Diverse Pilates, You agree now to contact me directly in a mature and professional way rather than to publicly make any negative or critical comments about the Program, the business, and/or Rachel Piper personally and individually through social media, public forums, or otherwise. The parties both agree now not to communicate with any other individual, company or entity in a way that is harmful or disparaging to the other, whether actual or perceptual, or to do or say anything that is injurious to each other’s reputation, including about the Program, the business, it’s employees, contractors or agents, other participants. In arbitration or when required by law, of course, the parties are not prohibited from publicly sharing our thoughts and opinions. 

 

PHOTO/VIDEO RELEASE: You hereby grant Size Diverse Pilates, its representatives, employees, or agents the right to take photographs and video footage of you and your property throughout the duration of the Program, and to use and publish these photos or videos in print and/or electronically. You agree that Size Diverse Pilates may use photographs or video footage of you with or without your name for any lawful purpose, including for such purposes as education, publicity, illustration, advertising and web content.  

 

By signing this Agreement, we both acknowledge that we have read, understand, agree to and accept all of the terms in this Agreement. Electronic signatures of this Agreement are permitted and enforceable. You agree that You have had the opportunity to ask Size Diverse Pilates any questions prior to signing, and your signature indicates that You are in agreement with all of the terms of this Agreement. 

 

EXHIBIT A: PROGRAM HOURS

 

Size Diverse Pilates reserves the right to modify the Program Hours and content as it best sees fit to accommodate students’ needs and the overall goals of the Program, and requirements of any certifying organizations.
